The US Environmental Protection Agency, Region 9 (EPA) is informing the Bureau of Customs and Border Protection of the U.S. Department of Homeland Security that the Pyraclonil Technical in the import ship should be Denied Entry-Refused Delivery into the United States pursuant to the authority of Section 17(c) of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). The importer, Nichino America, Inc., attempted to import a shipment of unregistered Pyraclonil Technical manufacturing use pesticide (Imported Product) into the United States. All pesticides are required to be registered with EPA before their entry into the Unites States, unless certain exemptions are met, Pursuant to Section 3 of FIFRA. The distribution of an unregistered pesticide, without an exemption, is an unlawful act under FIFRA Section 12(a)(1)(A).
