Case summary

Notice of Warning issued to Inter Valley Pool Supply, Inc. for failure to satisfy nonrefillable and refillable container standards with respect to two products packaged and/or sold at their facility. IVPS failed to label their containers of HASA Chlor, EPA Reg. No. 10897-26, held for sale on the date of the inspection, with the required lot number, batch or other code, per the requirements for non-refillable containers found at 40 CFR 156. 140(a)(4). IVPS was also holding for sale, cases of HASA Sani-Chior, EPA Reg. No. 10897-4, in refillable containers on the date of the inspection, which failed to meet the refillable container requirement found at 40 CFR 165.45(d), in that none of the refillable containers were durably marked in a clearly visible manner with a serial number or other identifying code that would distinguish each individual container from all other containers. Failure to meet the non-refillable and refillable container standards for registered pesticides is a violation of FIFRA 12(A)(1)(E) in each instance.
