Case summary
This is a Consent Agreement and Final Order (CA/FO) between US EPA and Pitman Farms, Inc, (Respondent), for Respondent's alleged violations of federal statutes at its Sanger Poultry facility in Sanger, California. The CA/FO simultaneously commences and concludes proceedings concerning violations at the facility of 1) the Risk Management Program contained in the regulations at 40 C.F.R. Part 68, promulgated pursuant to Clean Air Act Section 112(r)(7), and 2) the release notification requirements under Section 304 of the Emergency Planning and Community Right-to-Know Act, and Section 103 of the Comprehensive Environmental Response, Compensation, and Liability Act. Respondent paid a civil administrative penalty of $242,980, will perform Supplemental Environmental Projects (SEPs), valued at a minimum of $194,950 that will provide Emergency Response Equipment to the Fresno County Fire Department and will add additional ammonia refrigeration safety controls to provide for early detection and remote control of ammonia releases. This CA/FO also requires Respondent to invest in a new state-of-the-art ammonia refrigeration system at its new facility, at an estimated cost of over $8.37 million.
