Case summary

This is a penalty action for Cyanco's failure to promptly and properly notify applicable authorities of releases of hazardous substances above reportable quantities. On February 1, 2010 the facility released 30 pounds of hydrogen cyanide gas (which is above the RQ of 10 pounds) to the environment, but did not report the release to either the LEPC/SERC nor the NRC until approximately 29 hours after the release. On January 2, 2011 the facility released 90 pounds of sodium cyanide (which is above the RQ of 10 pounds) to the environment, but failed to notify either the LEPC/SERC or the NRC until 87 days after the release. Cyanco has agreed to pay a civil penalty of $52,600 to settle the violations.
