Case summary
In 2006 and 2008, Aloha Petroleum modified and reconstructed a gasoline bulk loading terminal loading rack, which triggered Clean Air Act New Source Performance Standards Subpart XX requirements. A 2011 referral to the Department of Justice seeks a civil penalty and injunctive relief -- installation of a VOC vapor processor. Also in 2011, a facility operator caused a diesel fuel tank to overflow, releasing 14,000 gallons of fuel into the environment. The facility is subject to Clean Water Act 311 Oil Spill Prevention, Control and Countermeasure (SPCC) requirements. In 2013, the CAA referral was supplemented to add the SPCC count under CWA 311.
