Case summary
AtKO Building Materials voluntarily self-disclosed violations of EPCRA Sections 311 and 312 to the EPA on August 18, 2009 in accordance with EPA's Incentives for Self-Policing: Discovery, Disclosure, Correction and Prevention of Violations Policy, dated May 11, 2000. ATKO failued to submit MSDS or a list of hazardous chemicals with 90 days of their presence on-site and failed to provide an annual chemical inventory of subject chemicals for the reporting years 2005-2009 for facilities in Mesa, Avondale, Tucson and Casa Grande, to the SERC and LEPCs as required.
