Case summary

On July 22, 2009, Judge Wilkens entered the Settlement Agreement requiring East Bay Municipal Utility District (EBMUD) to steps take to reduce, and eventually eliminate, wet weather sewage discharges from its wastewater collection system. The work required by the Settlement Agreement will lead to long term efforts to repair sewer lines and home laterals, reducing the influx of stormwater and groundwater into the sanitary sewer system. The Settlement Agreement requires EBMUD to undertake efforts to better maintain its collection system and to ensure that defective home laterals get repaired or replaced throughout the service area. In addition, EBMUD is to collect flow data to better identify what portions of the communities? collection systems contribute excessive wet weather flows to the EBMUD system. This will provide support for subsequent enforcement actions requiring the communities to improve their collection systems.
