Case summary
This is an Administrative Penalty Complaint issued to Coluccio Contstrution and Kaneohe Ranch, the former having been licensed by the latter, the landowner, to utilize a wetland area adjacent to Hamakua stream as a staging area for a nearby sewer construction project. Grading and discharges of fill material in the wetland area were performed by Coluccio without permits issued pursuant to section 404 of the CWA. A 2006 Administrative Order requires respondents to remove the fill material in the on-site wetland and restore the wetland area. Although a plan to do so has been developed, the restoration requirements have not yet been accomplished due to local permitting delays. This complaint seeks penalties up to $137,500.
