EPA v. Iron King Mine

Unilateral Administrative Order Without Adjudication

Case summary

This is an Administrative Order on Consent (AOC) that EPA Region 9 entered into with Ironite Products Company (Ironite) to conduct a Time-Critical Removal Action at the Chaparral Gulch Residential area of the Iron King Mine site in Dewey-Humboldt, Yavapai County, Arizona (Site). The Site is a portion of the Iron King Mine-Humboldt Smelter site where elevated levels of arsenic in yards at four residential properties pose an imminent and substantial endangerment to human health. These four residential parcels are believed to be impacted by erosion from the nearby Iron King Mine during rain and flood events. Ironite is the current owner and operator of 62 acres of the Iron King Mine. The AOC requires Ironite to conduct the removal action approved in an Action Memorandum dated April 11, 2006 and also pay EPA’s future response costs related to the Site. The work consists of soil excavation at four residential properties, transport and disposal of the excavated material to an EPA approved facility, replacement of excavated material with clean fill and restoration of the properties to pre-removal conditions.
