Case summary
This is an administrative penalty action pursuant to RCRA-UST (field citation) presented to the owner of Round Rock Trading Post on 8/22/05 for failing to: 1) provide a release detection method for Tank 2 (Tank 1 was empty); 2) comply with the financial responsibility requirements; and 3) ensure proper operation of his cathodic protection (CP) system (no 3-year CP test had been done). Subsequent to the field citation, the owner hired a contractor to remove the fuel from Tank 2 down to less than 1 inch and conduct a 3-year CP test (passing). The owner also attempted to obtain insurance for his USTs in temporary closure, but the insurance company (Zurich) said it does not issue policies for UST systems in extended temporary closure (only USTs that will come into service within 14 days). The owner stated in a faxed letter that he intends to remove these 2 old USTs after obtaining a loan from the Navajo Nation, and subsequently install above-ground storage tanks. Based on the insurance company's unwillingness to provide insurance for his USTs in temporary closure and the owner's stated intent to remove these USTs, the terms of the field citation were deemed satisfied and the action was closed without requiring further physical actions, and providing only for payment of a penalty in the amount of $900.
