EPA v. Casmalia Resources - Solitron

Final Order With Specified Cost Recovery

Case summary

This is an Administrative Order on Consent (AOC) pursuant to CERCLA 122(h)(1) issued to Solitron Devices, Inc. for its financial liability under CERCLA 107 at the Casmalia Disposal Site in California and four other sites in Florida. Solitron's aggregate liability at these sites is approximately $5 million although the present Order establishes that Solitron will pay $74,000 to EPA as a result of an ability-to-pay analyses performed by EPA and DOJ. The funds will go to reimburse the Superfund for work performed at one of the Florida sites because at that site Solitron is the sole Potentially Responsible Party (PRP), whereas at each of the other sites there are other PRPs from which to recover response costs.
