Case summary

This is one of two Administrative Orders on Consent (AOC) under the Clean Water Act that involves the Pala Band of Mission Indians. The present order addresses unauthorized discharge of dredge and fill material into the San Luis Rey River in the vicinity of a Casino owned by the Pala Tribe. The order requires that the Pala Tribe submit to EPA a Site Restoration Plan to restore the topographic and hydrologic features of the site to pre-existing or pre-disturbed conditions. Removal of earthen material and rock from the site must be completed before March 1, 2005 because of concerns regarding the habitat of the endangered arroyo toad. The AOC also requires that the Tribe submit a final report by April 1, 2005, which must provide photographs of the site upon completion of the restoration work.
