Case summary
This AO, pursuant to section 307 of the CWA, was issued to Seaport Refining & Environmental, LLC due to findings made during EPA's inspection of the Facility on January 5, 2004. This Order was issued due to Seaport's failure to submit its baseline monitoring report and its 90-day status report, which are required under the Federal categorical pretreatment standards at 40 CFR 403 (b) and (d), respectively. Seaport is also in violation of the Federal pretreatment standards at 40 CFR 403.6(d), which prohibit dilution as a substitute for treatment. Finally, Seaport has not been in compliance with 40 CFR 403.12(g), which requires that Seaport take representative samples of wastewater discharged to SBSA, a wastewater treatment plant located in Redwood City, California. The Order directs Seaport to submit its baseline monitoring report and 90-day status report, cease dilution as a substitute for treatment, and begin monitoring the Facility's wastewater discharge in a manner which is representative of the wastewater generated on-site.
