Case summary
Administrative compliance order to Ed Ben-Dor for unlawful discharges of dredged and fill material to wetlands adjacent to the Hanalei River on the island of Kauai in Hawaii. Mr. Ben-Dor had contractors excavate a pond in 2002 and 2003, as well as clear brush and deposit dredged material and imported gravel into approximately one-half acre of wetlands on his property near the river. This work was performed without a CWA Section 404 permit. The current AO requires Respondent to cease all unpermitted discharges, remove fill materials, and restore the wetlands.
