Case summary

This is the first of two actions against Embalajes Proem, Ltd., a Chilean company. This action is a combined Complaint / Consent Agreement and Final Order (CAFO) initiating and settling violations of FIFRA. Specifically, Embalajes Proem violated Section 12(a)(1)(E) of FIFRA by shipping to the Port of Long Beach, California, PROEM SLOW RELEASE GRAPE GUARD, a pesticide that was misbranded because its label did not bear the registration number assigned to the establishment where it was produced under Section 7 of FIFRA. Under the terms of the CAFO, the company must pay a civil administrative penalty of $2,310 and re-label the shipment of PROEM SLOW RELEASE GRAPE GUARD with EPA accepted labels before any further distribution of the product.
