EPA v. Unidynamics
Unilateral Administrative Order Without Adjudication
Case summary
This is an administrative compliance order, pursuant to CERCLA section 106(a) requiring Unidynamics-Phoenix, Inc. to remediate soil gas contamination at the Unidynamics facility. The Order directs Unidynamics to restart the site's soil vapor extraction (SVE) system as provided in the 1989 ROD and 2002 Explanation of Significant Differences for the Site. EPA issued a prior administrative order in 1990 pursuant to which Unidynamics operated an SVE system from 1994 until 1998. Unidynamics then refused to restart the system in 2002, which prompted EPA to issue this administrative compliance order.
