Case summary

On October 30, 2002 a Civil Judicial Referral was sent by EPA Region 9 asking that the Dept of Justice bring an action against S K Management for violations of TSCA regarding the leasing of housing in Los Angeles County, California. The violations involve Section 1018 of Title X of the Residential Lead-Based Paint Hazard Reduction Act of 1992 and the Real Estate Notification and Disclosure Rule at 40 C.F.R. Part 745, Subpart F. This enforcement action is part of a national enforcement initiative and is a joint effort of the United States Environmental Protection Agency (EPA), the United States Department of Housing and Urban Development (HUD) and the United States Department of Justice (DOJ). As part of this initiative, a group of inspectors from EPA, HUD and DOJ conducted joint inspections of approximately 50 landlords and property management companies with multiple apartment units in Los Angeles County, California in May of 1999, to determine compliance with the Disclosure Rule. As a result of these inspections, it was determined that S K Management had failed to make disclosures required by the Disclosure Rule to the lessees of up to 1,981 apartments units constructed before 1978. Settlement talks are underway and terms of a Consent Decree are under negotiation. Addendum: On May 8, 2003, the United States entered a Consent Decree settling its case against SK Management Company. Under the terms of the Consent Decree, SK is required to comply with the Disclosure Rule and agrees to inspect all of the covered properties in which it has a management interest for lead-based paint; implement on-going operations and maintenance in those properties that are not certified lead-based paint-free; abate the lead-based paint identified at two of the largest properties; perform a Child Health Improvement Project at a cost of $25,000; and pay a federal civil administrative penalty of $10,500 and a state civil penalty of $4,500 as part of a separate agreement with the State of California.
