Case summary
On December 4, 2002, EPA issued an administrative compliance order to Speedy's Convenience, Inc., which owns and operates a facility in the Navajo Nation near Lupton, Arizona. The facility processes transmix [a petroleum distilation product] through a splitter to separate the transmix into gasoline and diesel. EPA's order requires the company to prepare and submit notifications, testing and monitoring records, leak detection and repair records, and semi-annual reports that the company failed to maintain as required by the petroleum industry New Source Performance Standards (NSPS) at 40 C.F.R. Part 60, Subpart GGG. This facility has been the subject of previous EPA enforcement actions, including an August 1999 consent agreement in which the company agreed to pay a penalty of $68,600 for failure to prepare and implement a Spill Prevention Control and Countermeasure Plan. Furthermore, on August 23, 2002, Bruce Nicholson, the President of Speedy's Convenience, Inc., was sentenced to 42 months imprisonment and his brother, Brian Nicholson, was sentenced to 8 months imprisonment and 8 months of home confinement following their guilty pleas earlier this year in connection with what the U.S. Department of Justice believes to be one of the United States largest motor fuel tax evasion schemes
