Case summary

This is an adminstrative penalty action pursuant to RCRA issued to Superior Special Services, Inc. This case is undertaken in parallel with a case initiated by the Arizona Department of Environmental Quality (ADEQ) to resolve violations under an ADEQ Compliance Agreement for mercury recovery operations at the Superior Special Services facility. This case resulted from a joint EPA and ADEQ community-based project in the Southern Phoenix area. The EPA violations include universal waste labeling and marking violations and violation of the BIF exemption notice requirement. This case is being initiated and concluded with a combined Complaint and Consent Agreement/Final Order. The Respondent has agreed to pay a civil penalty of $18,150. [NOTE: After settlement with EPA, the State of Arizona and Respondent entered into a separate agreement which included a Supplemental Environmental Project (SEP) valued at $150,000 whereby Respondent would work with Phoenix Union High School in cleaning up and removing dangerous chemicals stored on school premises.]
