Case summary
'This is a Prospective Purchaser Agreemenet pursuant to CERCLA issued to the City of Phoenix, Arizona. Phoenix plans to acquire a 0. 5 acre parcel within the Motorola 52nd Street Superfund Site as part of an expansion plan for its Sky Harbor International Airport. This acquisition is the latest step in airport development begun in 2001, when Region 9 signed the first PPA with Phoenix, covering 6 parcels, 22 acres in extent. At that time, the Region agreed to issue an additional PPA if Phoenix needed to acquire more land within the Motorola 52nd Street Superfund Site, an area-wide groundwater contamination NPL site. In exchange for the first PPA, Phoenix paid EPA $100,000 in consideration of the covenant not to sue. For this second PPA, Phoenix will pay EPA $10,000, and will also provide access to the property and implement institutional controls, if necessary.'
