Case summary

This is a Civil Judicial Referral pursuant to TSCA in which EPA asks the Department of Justice to pursue an action against the Westside Rehab Corporation (known as the Alpha facility). The violation involves failure to make disclosures about lead-based paint required by the Disclosure Rule (Section 1018) to Lessees of approximately 949 low income apartment units built before 1978. The referral asks DOJ to lodge a proposed Consent Decree which will require Alpha to inspect all of their residential apartment buildings located in California and out-of-state for lead-based paint and to remove any lead-based paint identified in these buildings. Additionally, Alpha will agree to perform a Child Health Improvement Project at a cost of $35,000; and to pay a federal civil administrative penalty of $17,500. There will be a state civil penalty of $7,500 as part of a separate agreement with the State of California.
