'This is a Administrative Penalty Order pursuant to RCRA section 3008(a) issued to West Coast Cleaning and Preservation. West Coast is classified as a used oil transporter and used oil transfer facility. Used oil generated from tank and bilge cleaning operations is transported to West Coast?s transfer facility, and subsequently shipped to a third party used oil recycler. West Coast improperly stored and managed used oil at the transfer facility. The following violations were discovered: 1) Failure to ship offsite thirteen containers of used oil before the 35-day storage limit; 2) Failure to install secondary containment for 19 containers of used oil; 3) Failure to mark 19 containers of used with the words ?Used Oil?; and 4) Failure to maintain records of analyses conducted or information used to ensure that used oil is not hazardous waste. The Complaint seeks the maximum penalty allowed by the statute (notice pleading), in this case up to $27,500 per day per violation.'
