TOMKINS INDUSTRIES, INC., DOING BUSINESS AS LASCO BATHWARE OWNS AND OPERATES A BATHWARE MANUFACTURING FACILITY LOCATED AT HIDDEN VALLEY INDUSTRIAL PARK IN MOAPA, NEVADA THAT IS SUBJECT TO THE CLEAN AIR ACT'S PREVENTION OF SIGNIFICANT DETERIORATION PROGRAM AS SET FORTH IN THE STATE IMPLEMENTATION PLAN FOR NEVADA. PURSUANT TO THE REQUIREMENTS OF THE NEVADA SIP AND THE PSD PROGRAM, LASCO WAS REQUIRED TO OBTAIN A PERMIT AND INSTALL THE BEST AVAILABLE CONTROL TECHNOLOGY TO CONTROL AIR EMISSIONS FROM THE FACILITY. LASCO VIOLATED THE REQUIREMENTS OF THE NEVADA SIP AND THE PSD PROGRAM BY FAILING TO INSTALL BACT TO CONTROL EMISSIONS OF VOLATILE ORGANIC COMPOUNDS FROM THE FACILITY AND BY VIOLATING CONDITIONS IN THE PERMIT ISSUED TO IT FOR CONSTRUCTION OF THE FACILITY.
