EPA has determined that the Subject Products are parts or components intended for use with, or as part of, a motor vehicle or motor vehicle engine, that have a principal effect of bypassing, defeating, or rendering inoperative a device or element of design installed in the motor vehicle or motor vehicle engine in compliance with regulations under the Act (?defeat devices?), and that the manufacturer or seller should know the part or component is being offered for sale or installed for such use or put to such use, and are therefore prohibited by Section 203(a)(3)(B) of the Act. Thus, the Subject Products were manufactured, sold, or offered for sale in violation of the Act?s statutory and regulatory provisions, including those cited above. The EPA recommends that CBP seize or destroy the Subject Products.
