Case summary
On February 25, 2026, the EPA Region 8 Air and Toxics Enforcement Branch issued a Consent Agreement and Final Order to Dalbo Holdings, Inc. (DHI) for alleged Clean Air Act section 113(d) violations at two Utah oilfield wastewater disposal facilities (OWDFs), Ace Disposal Facility and Glen Bench South Disposal Facility, located on the Uinta and Ouray Indian Reservation. Based on an onsite inspection in 2018 and an information request in 2019, EPA alleged the operator violated section 502a of the Clean Air Act and Part 71 of its implementing regulations for failure to operate a major source of VOC emissions in compliance with Title V. EPA found the Glen Bench South facility emitted more than 100 tons of VOC in 2019 and the Ace Disposal facility emitted more than 10 tons of one single hazardous air pollutants (methanol) in 2019. Under the CAFO, DHI will pay a $60,000 in penalty, implement re-design and implement re-design and emission control at both facilities, and apply for federally enforceable synthetic minor permits.
