Case summary
On September 30, 2025 , Region 8 finalized a CAFO with Continental Resources, Inc., settling violations of the Clean Air Act. The violations were based on the results of EPA?s October 2023 flyovers of stationary sources in North Dakota and Montana. EPA issued a Notice of Violation (NOV) to Continental in July 2024. The NOV alleged that Continental violated provisions of the New Source Performance Standard (NSPS) and North Dakota Administrative Code. Those violations included failure to properly operate control devices. Under the CAFO, Continental has agreed to monitor flare operations and pay a $75,0000 civil penalty.
