Case summary

You are receiving a Notice of Warning at this time for the two BusseMF Sewage Treatment Systems referenced in the August 1, 2021, Memorandum (docketed as FIFRA-08-2021-0059) due to the fact that a review of public records indicate that the Jax Group is no longer an active business in either Utah or Michigan. However, Utah public records reflect that Busse West, LLC, is an active business that is engaged in a similar business to the Jax Group and appears to be under the same ownership. Publicly available records also indicate that Busse West, LLC, is actively engaged in the water treatment business in Utah and plans to expand that business in the near future (see e.g. Bull Hults testimony before the Utah Natural Resources, Agriculture, and Environment Interim Committee, October 19, 2022, available at: https://le.utah.gov/av/committeeArchive.jsp?mtgID=18273). Please be advised that the sale or distribution of a pesticide device, which includes the BusseMF Sewage Treatment Systems, must comply with the required registration and labeling regulations under FIFRA. Please note that any additional violations, including violations by Busse West, LLC, may be subject to further enforcement action, including civil or criminal penalties. Section 14(a)(1) of FIFRA, 7 U.S.C. ? 136l(a)(1), provides for the assessment of administrative penalties up to $24,255 for each day violation, as adjusted for inflation. 88 Fed.
