Case summary
On May 28, 2024, the EPA issued a unilateral administrative compliance order to Traditional Homes, LLC and MH Pablo, LLC for discharging pollutants in stormwater from their construction site on the Flathead Indian Reservation without a permit. The order directs Traditional Homes, LLC and MH Pablo, LLC either to stop discharging or to apply to the EPA for permit coverage. On May 2 the EPA transmitted a proposed Administrative Order on Consent under which Traditional Homes, LLC and MH Pablo, LLC would have agreed to apply for permit coverage. The EPA?s transmittal letter asked the parties to reply within 10 days of receipt if they were interested in entering into the Consent Order. The EPA received no reply. This action stems from the findings from the September 15, 2023 EPA inspection of the Traditional Homes' construction site. Traditional Homes, LLC applied for and received coverage under the NPDES Construction General Permit for Stormwater Discharges from Construction Activities on June 25, 2024.
