Case summary
Region 8 issued a Final Order approving an ESA between EPA and Farmers Union Oil, to resolve violations of the Resource Conservation and Recovery Act (RCRA) UST regulations, including failure to conduct annual automatic tank gauge (ATG), spill and overfill prevention equipment testing. The ESA was issued in response to violations from a November 2020 UST inspection conducted by EPA at the McLaughlin, South Dakota facility. Previous compliance assistance to the Facility representatives was not successful in returning the facility to compliance. The Facility has returned to compliance and agreed to pay a civil administrative penalty.
