Case summary
On March 20, 2019, an inspector for the U.S. Environmental Protection Agency conducted an inspection of Loveland Products Inc. in Loveland, Colorado, to determine compliance with FIFRA regulations. The inspector observed that Loveland Products Inc. was selling and distributing Malice 75 WSP, EPA Reg. No. 34704-1009. Malice 75 WSP was being marketed under a repack registration, that is, its registration was identical to an already registered product, ETI 105 12 I, EPA Reg. No. 228-682. However, when the registration of ETI 105 12 I, the parent product of Malice 75 WSP, was canceled in 2010, Malice 75 WSP was no longer a registered product. It is a violation of FIFRA to sell or distribute an unregistered product. The registration of Malice 75 WSP, EPA Reg. No. 34704-1009, was formally cancelled on September 23, 2020. It is a violation of FIFRA section 12(a)(1)(A) to sell or distribute an unregistered product.
