EPA v. Boxelder Sanitation District

Case summary

The EPA conducted a pretreatment compliance audit (PCA) on Dec 16-17, 2019, during which a number of significant findings were identified and communicated to the Boxelder Sanitation District (District). The PCA report was sent to the facility on Mar 24, 2020, and the District responded on Apr 24, 2020. A number of PCA findings were not sufficiently addressed in the District's response. The EPA attempted to provide outreach to the District, but was unsuccessful. The EPA proceeded with issuing a Letter of Violation on Sept 8, 2020, outlining the violations and held conferences with the District on Oct 8, 2020 and Oct 29, 2020. During these conferences, the violations were further explained to the District and the opportunity to provide additional records of corrective actions was provided. EPA proposed addressing the District's failure to implement the pretreatment program with an Administrative Order on Consent (AOC). The District was amenable to the proposed action and a draft AOC, which sought to return the District to compliance with pretreatment regulations was sent to the District for review on Jan 6, 2021. Following negotiation, the District and the EPA signed the final AOC on Feb 9, 2021 and Feb 10, 2021, respectively. The AOC was docketed and served on Feb 10, 2021.
