Case summary

Western Equipment & Truck, Inc., violated Clean Water Act Sections 404 and 402 when it discharged unauthorized dredged and fill material to the Big Thompson River and its adjacent wetlands and failed to comply with its state-issued construction stormwater permit. The AOC requires restoration of impacted wetlands at the site as well as correction of pollution prevention planning violations associated with the construction stormwater permit. The site is the Two Rivers Rock Mine at the confluence of the Big Thompson and Little Thompson Rivers in Weld County, Colorado. The EPA directly implements the CWA Section 404 program in Colorado and retains enforcement oversight authority for Colorado?s stormwater discharge permit program.
