Case summary

EPA initiated formal enforcement following unsuccessful attempts to return Class II injection wells to compliance using compliance assistance. Initially 140 violations were identified at 113 Class II injection wells located within the Uintah & Ouray Indian Reservation in Utah, under EPA direct implementation jurisdiction. A June 3, 2019 Complaint was issued seeking $67,390 penalty for six types of violations identified. Through negotiation with Crescent Point Energy, EPA identified one more Class II well in violation, one more type of violation and a total of 44 more instances of violations, bringing the total to 184 violations identified. The company returned all 114 Class II injection wells to compliance. To settle the matter, EPA on November 5, 2019, issued an Amended Compliant with the newly identified violations included. On November 13, 2019, EPA issued a Final Order and Consent Agreement with a $99,500 penalty to be paid within 30 days to resolve the matter.
