Case summary
On April 14, 2016, EPA Region 8 filed an Administrative Order on Consent (Consent Order) with Brent?s Biffies, Inc. (Brent?s Biffies) under section 309 of the Clean Water Act for illegally land applying domestic septage on the Fort Berthold Reservation. The Consent Order requires that Brent?s Biffies cease all application of domestic septage to land unless the application complies with the requirements set forth in the EPA?s domestic septage regulations, including application rate and record keeping requirements. Brent?s Biffies is required to submit four consecutive quarterly reports to the EPA detailing the method and manner of all land application of domestic septage in accordance with the regulations. Region 8 will consider closing the Consent Order after 12 months, depending on Brent?s Biffies? compliance with the Consent Order and underlying regulations.
