CLEAN AIR ACT SETTLEMENT WITH LINN OPERATING, INC., FOR VIOLATIONS AT GAS PROCESSING PLANT IN UTAH: The EPA and LINN Operating, Inc. have reached a settlement regarding nitrogen oxide emissions from a compressor engine at the Brundage Canyon Gas Processing Plant near Duchesne, Utah. This facility is located on the Uintah and Ouray Indian Reservation. Representatives of the Ute Indian Tribe were present during the testing conducted at the facility and a tribal consultation/interest letter was sent to the Ute Indian Tribe prior to entering into settlement negotiations with LINN. Notification that the there is a pending settlement between the EPA and LINN has been sent to the Ute Indian Tribe. LINN has come into compliance with the New Source Performance Standard, Subpart JJJJ, and will pay a civil penalty of $100,000. The Combined Complaint and Consent Agreement will be filed with the Regional Hearing Clerk, with the request that it be issued as a Final Order by the Regional Judicial Officer.
