Case summary

On August 5, 2015, EPA Region 8 filed a Combined Complaint and Consent Agreement (CCCA), which initiates and resolves claims under the Clean Water Act for alleged NPDES violations by Knife River Corporation ? North Central (Knife River) at the Watford City Bypass located in Watford City, North Dakota. EPA alleges in the CCCA that Knife River (1) failed to adequately install and maintain best management practices which led to sediment accumulation in Cherry Creek and Spring Creek and (2) failed to include a concrete/asphalt batch plant for the site in the storm water pollution prevention plan and map. These alleged violations were discovered during a NPDES inspection in July 2014. The CCCA requires Knife River to pay a penalty. EPA Region 8 worked with the North Dakota Department of Health regarding this settlement. The CCCA was subject to a 30-day public comment period. The final order for the CCCA was issued on September 23, 2015.
