EPA v. AMERICAN GILSONITE COMPANY
Final Order No Penalty
Case summary
The American Gilsonite Company (AGC) operates the Bonanza Mine, a non-tribally owned or operated Gilsonite mine located within the exterior boundary of the Uintah & Ouray Reservation in Utah. The EPA found 36 compliance samples collected by AGC from 2011 to the present that are in violation of their NPDES permit. The majority of the violations were for total dissolved solids (TDS); other violations were for oil and grease and total suspended solids. The AOC requires AGC to address the ongoing TDS issues and other violations by April 30, 2016. AGC plans to install a one or more underground injection control (UIC) wells to dispose of wastewater, instead of pursuing very costly treatment measures.
