Case summary

In July of 2012 the respondent constructed an earthen dam across Bear Butte Creek for the purpose of creating a swimming feature at the campground during the Sturgus SD Cycle Rally. The dam was 75 feet long, 20 feet wide and 6 feet high. Approximately 500 cubic yards of fill material was used to construct the dam. The dam created a swimming pool extending approximately 500 feet upstraem, resulting in stream flow reductions downstream. In addition the respondent constructed two cross channel leves, excavated the same channel, constructed recreational beaches. The project impacted 640 linear feet of natural channel and 1,280 linera feet of riverine shoreline.
