Case summary

The EPA Region 8 NPDES Enforcement Team within ECEJ has settled a Combined Complaint and Consent Agreement with Alan Kruckenberg Construction, Inc., for failing to obtain and to maintain a stormwater permit for the construction activities in the housing development known as On the Hill in Millcreek, Utah. SWPPP deficiencies were identified in the inspection report. No response was received at that time. AKC was sent an Administrative Order for Compliance on June 18, 2013, and the documents were then sent to the EPA by AKC. Subsequent tot he Order, the EPA and Respondent entered into a Combined Complaint and Consent Agreement (CCCA), for which the Final Order was issued December 16, 2014. In the CCCA, Respondent agrees to pay a penalty
