Christopher Lovato is one of two Operators along with the Owner who discharged dredged or fill material into Sheep Creek and its adjacent wetlands (86 sites over 1.66 miles) near Saguache, Colorado, without a permit, in violation of section 301(a) of the CWA, 33 U.S.C. § 1311(a), which prohibits the discharge of a pollutant unless authorized by a permit issued under section 404 of the CWA, 33 U.S.C. § 1344. Separate penalty actions have been issued to the Owner (Robert Gregg Sease - CWA-08-2014-0018) and 2nd Operator (Skoglund Excavating, Inc- CWA-08-2014-0027). The Owner, Robert Gregg Sease has agree to resolve the injunctive relief portion of this case under AOC CWA-08-2014-0024.
