EPA v. DOHN CONSTRUCTION INC COR03K161

Final Order With Penalty

Case summary

The EPA staff conducted a construction stormwater inspection at the above referenced site on September 11, 2013. Violations of the State of Colorado Construction Storm Water General Permit (General Permit) were observed during the inspection, including: failure to conduct inspections (no inspections in August 2013 and September 2013) and failure to properly install and maintain stormwater Best Management Practices (BMPs) to minimize sediment from leaving the site. The site encompasses 6.39 acres with approximately 6.39 acres disturbed during the inspection. The project is 60 percent complete and is expected to be finished by February 10, 2014. BMP implementation and maintenance at the time of the inspection did not satisfy the requirements of the General Permit. During the field inspection, the inspector?s observed: a) A stormwater outlet was unprotected in one location; b) Silt fence was knocked down and in need of maintenance. c) Straw wattles were not trenched or stake into the ground. On September 20, 2013, Dohn Construction, Inc. submitted information indicating that BMPs had been fixed and SWMP was revised to address the deficiencies identified in the inspection.
