Case summary
The Order requires that Black Gold cease all application of domestic septage to land unless the application complies with the requirements set forth in the EPAs domestic septage regulations, including application rate and pathogen and vector attraction reduction. Black Gold is required to submit four consecutive quarterly reports to the EPA detailing the method and manner of all land application of domestic septage in accordance with the regulations. Region 8 will consider closing the Order after 12 months, depending on Black Golds compliance with the Order and underlying regulations. NPDES Enforcement has coordinated closely with North Dakota Department of Health on this matter.
