Case summary

THE RESPONDENT DISCHARGED PETROLEUM CRUDE OIL INTO WEST CREEK AND UPON ITS ADJOINING SHORELINES AND SURROUNDING WETLANDS IN QUANTITIES AS MAY BE HARMFUL . Around mid-day (approximately 11:14 a.m. loca time) on October 24, 2011, a tanke owned and operated by Basin Western, Inc. truck carrying 7,700 gallons of crude oil rolled over on Highway 141, near mile marker 128. The location is in a very remote area, roughly 30 miles south of Grand Junction and approximately 10 miles east of Gateway, Colorado, in Mesa County, Co. During the the crash the tanker ruptured resulting in the discharge of between 3,000 - 7,000 gallons of crude oil into and around West Creek. West Creek flows into Deloris River near Gateway, Colorado. Doloris River is a navigable waters of the US.
