Case summary
RESPONDENT CONTINUED TO DUMP SEWAGE, VIOLATING A NOV FROM THE STATE AND EPA. On September 6, 2012, EPA Region 8 filed an Administrative Order against Mon-Dak Water & Septic Service LLC under section 309 of the Clean Water Act for illegally land applying domestic septage in Western North Dakota. The Order requires that the company cease all application of domestic septage to land unless the application complies with the requirements set forth in the domestic septage regulations including application rate, pathogen and vector attraction reduction. The company is required to submit to the EPA eight consecutive quarterly reports detailing the method and manner of all land application of domestic septage in accordance with the regulations. Region 8 will consider closing the Order after 24 months depending on the companys compliance with the Order and underlying regulations.
