RESPONDENT HAD NOT SOUGHT OR OBTAINED AUTHORIZATION FROM CDPHE TO DISCHARGE STORM WATER FROM THE SITE UNDER THE APPLICABLE GENERAL PERMIT OR ANY INDIVIDUAL PERMIT. Berts Model A, an auto salvage yard, had violations identified through a May 12, 2011 inspection of the Denver, Colorado facility. Berts Model A had not obtained permit coverage under the Colorado Discharge Permit System General Permit for Stormwater Discharges, and inspectors observed stormwater running off the site. Region 8 consulted with the Colorado Department of Health and Environment (CDPHE) of the intended enforcement action. A communication strategy has been developed.
