Case summary
Newfield agreed to a penalty for failing to demonstrate and maintain adequate financial responsiblity for its EPA regulated injection wells from March 2009 through September 2010, when it obtained an alternate financial instrument. During this period, Newfield failed to pass all the ratios required to use its financial statement as a demonstration of financial responsiblity. The Consent Decree prohibits Newfield from using its financial statement as demonstration of financial responsibility until 2014, and incorporates stipulated penalties for failure to comply with the Consent Decree when and if Newfield chooses to use its financial statement as demonstration of financial responsibility in the future. The Consent Decree is in effect for three years.
