EPA v. Birney/Muddy Cluster Water Systems

Final Order No Penalty

Case summary

This Emergency Order is issued to the Northern Cheyenne Tribal Council for violations at the Birney and Muddy Cluster Water Systems. The Order is based on a loss of pressure in both distribution systems, which can cause a net movement of water from outside the pipe to the inside through cracks, breaks, or joints that are common in all water systems. Such a system failure may carry with it a high potential that fecal contamination or other disease causing organisms to enter the distribution system.
