Four members of the Ute Indian Tribe of the Uintah and Ouray Reservation have intervened as plaintiffs. QEPFS violated: the NESHAP Oil and Natural Gas Production Facilities, Subpart HH; the NESHAP for Stationary Reciprocating Internal Combustion Engines, Subpart ZZZZ; the New Source Review/Prevention of Significant Deterioration (PSD) requirements; and the federal operating permit requirements under Title V of the CAA. The trust will fund air pollution-related environmental projects on the Uintah and Ouray Reservation, including projects to reduce air emissions on the Reservation, mitigate the impacts of air pollution on tribal members, screen for air pollution-related health impacts among tribal members, and educate tribal members about the impacts of air pollution on public health and the environment. After completion of the requirements of the consent decree, the total reductions from the five facilities are estimated as follows: 210 tpy NOx, 219 tpy CO, 166 tpy VOCs, and 17 tpy of HAPs.
