Case summary

In January 2003, US EPA issued Cargill a national Section 114 information request for PSD-related information concerning its nationwide grain mill and oilseed facilities, including the North Dakota facilities. In April 2003, Cargill met with EPA and DOJ to discuss a global resolution of requirements related to PSD regulations. Cargill did not agree to resolve these matters as part of a national global consent decree. DOJ, on behalf of EPA, then commenced developing an enforcement action against Cargill for violations of the CAA at its grain mill and oilseed facilities. This referral is to include Cargill's North Dakota facilities in the national enforcement action.
