This consent agreement is issued to OMG Americas - Apex Operation for illegal disposal of hazardous waste. Respondent does not have, and never has had a permit from either EPA or the State of Utah for the treatment, storage, or disposal of hazardous waste at the facility. Respondent also failed to make hazardous waste determination, failed to conduct weekly inspections, failed to make arrangements with local hospitals regarding worst case discharge, and failed to locally distribute a contingency plan. EPA and the Respondent have agreed to settlement of this matter before the filing of a complaint, and to execute this Consent Agreement, and to simultaneously commence and conclude this matter upon issuance of a final order
